These General Terms and Conditions (“Terms and Conditions”) apply to the provision of furnished apartments to accommodate the Guest and to all other services and supplies of the Hotel in this context. In the following context, "hotel" means the accommodation business "Ariv", the individual rooms are hereinafter referred to as apartments. These Terms and Conditions form an integral part of every contract. Contractual conditions of a guest or corporate partner that contradict or deviate from these General Terms and Conditions will not be recognized. Otherwise, the relevant provisions of the Swiss Code of Obligations ("CO") apply, excluding the provisions of the rental agreement.
The host reserves the right to change these terms and conditions at any time.
By agreeing to these terms and conditions, the guest also agrees to the house rules. These can be found here.
The contractual partner for the Ariv (Badenstrasse 1, 4057 Basel) is Future Living AG (Ernst Nobs-Platz 1, CH-8004 Zurich), which acts as the operating company for the hotel (hereinafter "host"). All credit card charges are collected on behalf of the Host or an entity affiliated with the Host.
The contract is concluded when the host accepts the guest's application in writing. The contractual partners are the host and the guest. If a third party has booked for the guest, he or she is jointly and severally liable with the guest for all obligations towards the host arising from the contract.
The apartments are designed for temporary use and can be used for three months.
Subsequent contract renewals are subject to availability and cannot be guaranteed. Booking conditions may vary.
Only as many people are allowed to stay in an apartment as contractually agreed. Additional people staying in the apartment must be officially registered and their details must be left with the host. Additional people also cost extra, this varies depending on the length of the stay. The host leaves the respective apartment to the guest for private use. The guest is not permitted to rent or rent the apartment to third parties without the prior written consent of the host. In addition, it is also strictly forbidden to operate or use the apartment commercially.
The guest is not allowed to make any structural changes to the apartment. The house rules are part of these general terms and conditions, and the guest agrees to comply with these house and usage rules (common rooms, laundry room, shared kitchen, fitness room, etc.).
The host is obliged to make the apartment booked by the guest available at the agreed time and to provide the agreed services. In the event of overbooking or delay in reopening, the host reserves the right to postpone the start of the accommodation contract to the next available date. In this case, any claims for damages by the guest are excluded.
The prices can be changed by the host if the guest subsequently makes changes in the number of people, the number of apartments booked, the services provided by the host, the length of stay and the period. The host must first agree to any changes before they are confirmed.All prices are stated in Swiss francs (CHF) and include VAT at the applicable rate. If the VAT rate changes on the day the service is provided, the agreed prices will change accordingly. The host is entitled to subsequently levy the VAT increase. The price does not include the guest tax, which is charged to the guest in accordance with local legal regulations.

Invoices from the host without a due date are payable without deductions immediately upon receipt of the invoice. The host is entitled to demand the price for the provision of the furnished apartments, in whole or in part, as well as other claims that arise, to be due at any time and to demand immediate payment.
In the event of late payment, the host is entitled to charge the statutory default interest.
The guest bears the full amount of bank fees that may arise in the event of a bank transfer.
For bookings of up to and including 6 nights
For bookings lasting from 7 to 13 nights inclusive
For bookings with a length of 14 to 27 nights
Long stay bookings with a refundable rate can be canceled free of charge up to 14 days before arrival. Cancellations within 14 days of arrival will incur a first month fee. If you need to end your stay early during your contract term, you can do this by notifying us in writing at least 14 days before your desired move-out date.
For all cancellations, the services provided by the host in advance must always be paid for in full. In addition, the host reserves the right to contractually specify individual cancellation conditions.
If the guest's free right of withdrawal within a certain period of time has been agreed in writing, the host is entitled to withdraw from the contract within this period.
If the agreed first invoice is not paid on time, the host is also entitled to withdraw from the contract.
Furthermore, the host is entitled to withdraw from the contract extraordinarily for objectively justified reasons, for example if force majeure or other circumstances for which the host is not responsible make the fulfillment of the contract significantly more difficult or impossible, apartments are booked with misleading or false information about essential facts, e.g. the person of the guest or the purpose, the host has reasonable grounds to believe that the use of the services endangers the smooth running of the business, the security or the public reputation of the host can.
The host must immediately inform the guest about the exercise of the right of withdrawal. Any claims for damages by the host against the guest remain expressly reserved. In return, the guest is not entitled to compensation if the host's withdrawal is justified.
In the event of an extraordinary termination, the guest is obliged to vacate the apartment. In urgent cases, the host is entitled to block the guest's key/batch and eject them from the building.
Each guest receives a key card in addition to mobile access. If the key card is lost, the guest will be charged for all costs of replacing it. The cost of a key card is CHF 25.00. The card must be returned immediately after check-out.
Dogs are allowed on our premises, but only if they are officially registered at the time of reservation/booking. There are only a limited number of rooms where dogs are allowed, so a reservation with a dog must first be officially confirmed. The guest must have availability confirmed in writing.
Upon request, the guest must be able to show the dog's vaccination certificate.
The host will charge the guest with a dog an additional daily or monthly fee, depending on the individual contract.
In case of damage to the building and inventory (furniture, decorations, etc.) or if a person is injured, the guest is fully responsible and must pay for any damage.
Dogs are only allowed in assigned rooms and on the first floor. Dogs are not allowed to move freely in the co-working area and are not allowed in the communal kitchen. In general, dogs must always be kept on a leash in the building.
If a dog is too noisy, damages property or disturbs other guests, the host has the right to terminate the contract at any time.
Other pets are not allowed unless specifically confirmed in writing by the host.
The cleaning and maintenance staff has permission to enter the apartment without the guest present in order to clean it or repair technical defects. This is particularly true in emergencies, e.g. B. in the event of water or fire damage.
Ariv reserves the right to enter the apartment for viewings. Viewings are announced at least 24 hours in advance.
The guest undertakes to avoid any misuse of the apartment and its facilities. The guest is liable to the host for any damage, loss or other damage to the apartment caused by him or third parties. The guest is obliged to reimburse the replacement value (especially in the event of theft or damage to furniture and equipment). The guest must bear the fire department's costs if a false alarm is triggered due to carefully produced smoke and vapor (including candle smoke, cigarette smoke, burnt food, etc.).
The host declines all liability for theft and damage to property brought by the guest or third parties.
The host is only liable in the event of intentional or grossly negligent contractual or non-contractual damage and only for direct damage. Any further liability, particularly in the case of slight or moderate negligence or for indirect damage, is excluded.
The guest is informed that his or her personal belongings are not insured under the risks of accommodation by the host. The risks include, for example, accidents (particularly falls on stairs, accidents due to inadequate snow removal and accidents due to incorrect operation of the equipment, kitchen elements and washing towers provided), illness, theft, water and fire damage. Insuring the items brought by the guest is the responsibility of the guest.
In addition, the guest is recommended to take out liability insurance with damage cover for the entire period of accommodation. This insurance should also cover the risk of breakage for all mirrors, glass, ceramic/stone fixtures such as hobs, vanities, toilets, bathtubs etc.
Smoking is prohibited throughout the hotel. The guest pays the host a flat rate of CHF 250 per violation. Legal representatives are liable for people they are required to supervise.
In the event of loss or damage to motor vehicles and bicycles parked or maneuvered on the property, as well as their contents, the host is not liable, unless there is intent or gross negligence.
Messages, mail and shipments of goods for the guest are handled with care. The host takes over the delivery, storage and - upon request - the forwarding of the same against payment. This does not constitute a retention task.
No liability is accepted for lost items. These will only be returned upon request against payment.
The Host assumes no liability for any damage resulting from the use of the Internet (including spam, viruses or connection problems), although the Host makes every effort to ensure a stable Internet and telephone connection. The guest is not entitled to a refund. The Guest is responsible for protecting their own devices from malware to prevent spam or viruses from being sent over the Host's network. The host reserves the right to exclude the guest from the network.
If these terms and conditions are not adhered to, the host reserves the right to warn the guest, block his key, expel the guest from the apartment and remove his private property from the apartment.
If individual provisions of these General Terms and Conditions are invalid, this will not affect the effectiveness of the remaining provisions. In such a case, the legally invalid provision will be replaced by a regulation that comes closest to the invalid provision in economic terms, but is effective.
This accommodation contract is subject exclusively to Swiss law. The exclusive place of jurisdiction for all legal disputes arising from the contract is Zurich.
In the event of legal disputes, the German version of the contractual provisions, these general terms and conditions and the house rules apply.
If the renter and the guest, i.e. the using person, are not identical, the renter guarantees that the guest agrees with the processing of his personal data by Ariv - Future Living AG, according to the provisions of the booking contract. The renter also guarantees that the guest knows his rights regarding such processing according to the booking contract. If the renter does not comply with this provision, he indemnifies and holds Ariv - Future Living AG harmless from all damages and claims (including costs and expenses arising therefrom).
For the execution of this booking contract, personal data of the guest, i.e. the person using an apartment, will be processed by Ariv-Future Living AG. Without the provision of personal data of the guest, this booking contract does not come into effect. The guest expressly consents to the processing of his personal data for the purpose of executing this contract. The guest further agrees that Ariv - Future Living AG may transmit his personal data to Swiss authorities or to third parties involved in the execution of this contract (e.g. cleaning service providers). The personal data will be stored for the time required by law. The guest has the right to request information from Ariv-Future Living AG regarding the correction or deletion of personal data or the restriction of processing, or to object to processing, as well as the right to data portability. The guest has the right to lodge a complaint with a supervisory authority. This consent can be revoked at any time.
If the landlord and the guest, i.e. h. the person using them is not identical, the landlord guarantees that the guest agrees to the processing of his or her personal data by Ariv - Future Living AG in accordance with the provisions of the booking contract. The landlord also guarantees that the guest is aware of his rights in relation to such processing in accordance with the booking contract. If the landlord does not fulfill this provision, he will indemnify Ariv - Future Living AG from all damages and claims (including costs and expenses resulting from this).
In order to carry out this booking contract, the guest's personal data, i.e. h. of the person using an apartment is processed by Ariv-Future Living AG. This booking contract will not be concluded without the guest providing personal data. The guest expressly declares his consent to the processing of his personal data for the purpose of implementing this contract. The guest further agrees that Ariv - Future Living AG may transmit his or her personal data to Swiss authorities or to third parties involved in the implementation of this contract (e.g. cleaning service providers). The personal data will be stored for the period required by law. The guest has the right to request information from Ariv-Future Living AG about the correction or deletion of personal data or the restriction of processing, or to object to the processing, as well as the right to data portability. The guest has the right to lodge a complaint with a supervisory authority. This consent can be revoked at any time.
